Mining in the United States: overview | Practical Law

The General Mining Law of 1872 ( 30 USC §§ 21-54, 611-615 ), as amended, is the principal law governing locatable minerals on federal lands. The General Mining Law gives US citizens the opportunity to explore for, discover and purchase certain valuable mineral deposits on federal lands open for mineral exploitation.

The U.S. Department of Interior Bureau of Land Management and the U.S. Department of Agriculture Forest Service regulate mining activities on federal land managed by these agencies. The U.S. Army Corps of Engineers, EPA, and state agencies also have roles in regulating the mining industry.
